Medicare Choose Terms of Service
Effective date: June 8, 2026
These Terms of Service govern access to and use of Medicare Choose, including the Medicare Choose website, web application, mobile application, Medicare plan comparison tools, educational materials, account features, agent-facing features, lead-request features, and related services. By accessing or using the Service, creating an account, saving a comparison, requesting to be connected with a licensed insurance agent, or using any agent-facing feature, you agree to these Terms. If you do not agree to these Terms, do not use the Service.
1. Medicare Choose's Role
Medicare Choose is an independent Medicare information and plan-comparison platform. Medicare Choose is not Medicare, CMS, a government agency, an insurance company, a Medicare Advantage organization, a Medicare Part D sponsor, a Medicare Supplement insurer, or a health plan. Medicare Choose does not offer, sell, underwrite, issue, administer, enroll users in, or make final enrollment decisions for Medicare Advantage, Medicare Supplement, Medicare Part D, or other insurance products.
Medicare Choose may be considered a Third-Party Marketing Organization when it performs lead generation, marketing, referral, or related functions in connection with Medicare Advantage or Medicare Part D plan options. Medicare Choose may be compensated by licensed insurance agents, insurance agencies, or other third parties that pay fees to be eligible to receive beneficiary inquiries or lead information, subject to applicable law and required beneficiary consent.
2. Not Medicare or a Government Website
Medicare Choose is not a government website and is not connected with, endorsed by, approved by, or affiliated with the U.S. government, CMS, Medicare.gov, the federal Medicare program, or any federal or state agency. Official Medicare information is available through Medicare.gov and 1-800-MEDICARE. TTY users may call 1-877-486-2048.
3. Educational and Comparison Tool Only
The Service displays Medicare-related information for educational and comparison purposes only. Comparison results may be based on information you enter, including ZIP code, county, current plan, prescriptions, dosage information, pharmacy preferences, doctors, plan preferences, and other information you choose to provide.
The Service is not a substitute for individualized advice from Medicare, a plan sponsor, your health care providers, a licensed insurance agent, a State Health Insurance Assistance Program, or other qualified professionals. Medicare Choose does not provide legal, tax, financial, medical, or individualized insurance advice.
4. Source and Accuracy of Plan Information
Medicare Choose obtains plan-related information from CMS, Medicare.gov, CMS data sources, publicly available data, and/or other permitted sources. Plan information can change. Medicare Choose works to provide useful and current information, but does not guarantee that all information is complete, current, accurate, error-free, or applicable to your specific circumstances.
Before making any enrollment decision, you should confirm all relevant information directly with Medicare.gov, 1-800-MEDICARE, the applicable plan sponsor, your providers and pharmacies, SHIP, and/or a licensed insurance agent.
5. Required Medicare/TPMO Disclaimer
We do not offer every plan available in your area. Any information we provide is limited to the plan information available through Medicare Choose and, if you request agent assistance, to the plans that may be offered or discussed by the licensed agent or agency with whom you are connected. Please contact Medicare.gov, 1-800-MEDICARE, or your local State Health Insurance Assistance Program to get information on all of your options.
6. No Enrollment Obligation
Using Medicare Choose, viewing plan comparisons, saving your information, creating an account, or asking to be connected with a licensed agent does not require you to enroll in, purchase, switch, or cancel any Medicare plan or insurance product.
7. Beneficiary Accounts, Saved Profiles, and User Information
Some features may allow beneficiaries to create accounts, save plan comparisons, save prescription or preference information, retrieve prior comparisons, or share information with a licensed agent. These features may require separate consent or additional disclosures. You are responsible for providing accurate, complete, and current information and for maintaining the confidentiality of your login credentials.
8. Agent Connection and Lead Request Features
If you request to be connected with a licensed insurance agent or agency, Medicare Choose may share the information you authorize with one or more licensed agents or agencies, subject to applicable law and the consent you provide. Agents or agencies may pay Medicare Choose a fee to be eligible to receive beneficiary inquiries or lead information.
Medicare Choose does not guarantee that any agent or agency will contact you, represent every plan available in your area, recommend any particular plan, or be able to assist with every product type. Independent agents and agencies are responsible for their own advice, recommendations, representations, marketing, enrollment assistance, licensing, appointments, certifications, and regulatory compliance.
A request to be connected with an agent does not obligate you to speak with the agent, purchase insurance, enroll in a plan, or change your existing coverage.
9. Telephone, Text Message, and Email Consent
Medicare Choose may present separate consent language before sharing your information with an agent or agency or before enabling marketing, enrollment-related, telephone, text message, or email contact. You are not required to consent to marketing calls or text messages as a condition of using the plan-comparison tool.
Agents, agencies, and other recipients of beneficiary information are responsible for complying with applicable federal and state telemarketing, privacy, insurance, Medicare, CMS, do-not-call, text-message, email, and consent requirements, including any requirements for prior express written consent where applicable.
10. Agent and Agency Users
Licensed agents and agencies that use Medicare Choose must maintain all required licenses, appointments, certifications, registrations, carrier approvals, errors-and-omissions coverage, and other qualifications required to market, discuss, sell, or enroll beneficiaries in Medicare-related products.
Agent and agency users agree to comply with all applicable Medicare, CMS, federal, state, carrier, privacy, marketing, telemarketing, TCPA, CAN-SPAM, do-not-call, insurance, recordkeeping, consent, and consumer-protection requirements. Agent and agency users may use beneficiary information only for the purpose authorized by the beneficiary and permitted by Medicare Choose.
11. Scope of Appointment and Enrollment-Related Rules
If Medicare Choose enables Scope of Appointment, plan-specific marketing, or enrollment-related features, those features may require separate disclosures, consents, forms, notices, waiting periods, records, or workflow requirements. Users and agents must comply with any applicable CMS, Medicare, carrier, and state-law requirements before engaging in marketing or enrollment-related activity.
12. Privacy
Your use of the Service is also governed by the Medicare Choose Privacy Policy and any specific consent forms or disclosures presented to you.
13. Acceptable Use
You may not use the Service to:
- violate any Medicare, CMS, insurance, privacy, telemarketing, marketing, carrier, or consumer-protection requirement;
- submit false, misleading, fraudulent, or unauthorized information;
- impersonate another person or misrepresent your identity, authority, licenses, appointments, certifications, affiliations, or credentials;
- attempt to gain unauthorized access to the Service, accounts, systems, data, or networks;
- scrape, copy, crawl, harvest, or extract data from the Service except as expressly permitted in writing by Medicare Choose;
- resell, redistribute, or misuse plan data, beneficiary information, leads, or agent information;
- upload malicious code, interfere with security features, disrupt the Service, or test the vulnerability of the Service without written permission;
- use the Service to send unlawful, unsolicited, misleading, or noncompliant communications; or
- assist another person in doing any of the foregoing.
14. Intellectual Property and Limited License
The Service, including text, design, software, workflows, user interfaces, databases, branding, logos, and other content created or provided by Medicare Choose, is owned by Medicare Choose or its licensors and protected by applicable laws. Subject to these Terms, Medicare Choose grants users a limited, revocable, nonexclusive, nontransferable license to access and use the Service for its intended purposes.
15. Third-Party Services, Links, and Data Sources
The Service may contain links to Medicare.gov, plan websites, government websites, agent or agency websites, carrier websites, pharmacies, providers, or other third-party resources. Medicare Choose is not responsible for third-party websites, services, data, content, privacy practices, security practices, or representations.
16. Availability and Changes to the Service
Medicare Choose may update, modify, suspend, limit, or discontinue any part of the Service at any time. Medicare Choose does not guarantee uninterrupted or error-free access to the Service.
17. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICARE CHOOSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, CURRENTNESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.
MEDICARE CHOOSE DOES NOT GUARANTEE THAT THE SERVICE WILL IDENTIFY THE LOWEST-COST PLAN, THE BEST PLAN, ALL AVAILABLE PLANS, ALL APPLICABLE BENEFITS, ALL PROVIDER OR PHARMACY NETWORK ISSUES, OR ALL FACTORS RELEVANT TO YOUR DECISION.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICARE CHOOSE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICARE CHOOSE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO MEDICARE CHOOSE FOR USE OF THE SERVICE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Medicare Choose and its owners, officers, employees, contractors, service providers, and affiliates from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your violation of these Terms, your violation of law, your misuse of information, or your infringement or violation of another person's rights.
For agent and agency users, this indemnification obligation includes claims arising from licensing issues, marketing or enrollment conduct, beneficiary communications, TCPA or telemarketing violations, CMS or Medicare violations, privacy violations, unauthorized disclosure or use of beneficiary information, carrier compliance issues, and misrepresentations to beneficiaries or Medicare Choose.
20. Suspension or Termination
Medicare Choose may suspend or terminate access to the Service at any time if Medicare Choose believes a user has violated these Terms, violated applicable law, created risk for Medicare Choose or others, misused beneficiary information, failed to maintain required credentials, or engaged in conduct inconsistent with Medicare Choose's compliance obligations or business interests.
21. Governing Law and Venue
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules, except to the extent federal law applies or preempts state law. Unless otherwise required by law, any dispute arising from or related to these Terms or the Service shall be brought in the state courts in York County or federal courts located in the Rock Hill Division in South Carolina, and the parties consent to personal jurisdiction and venue in those courts.
22. Changes to These Terms
Medicare Choose may update these Terms from time to time. Updated Terms will be posted through the Service with an updated effective date. Continued use of the Service after updated Terms are posted means you accept the updated Terms, except where additional notice or consent is required by law.
